October 12, 2007 More Complaints on Unifund

My name is Jamii Stone and I am writing on behalf of my husband Mark Barackman. I recently checked Mark's credit report and found that UNIFUND bought his credit card debt that was last active 2001 yet Unifund states that the last activity on the account is Sep. 2005 yet the account says it was "written off" by the originator Providian Bank in 2001. Is this legal for Unifund to do this? I have not yet contacted Unifund or Providian and they have not contacted either of us. I am afraid and I don't know what to do. How do I get Unifund off my husbands credit report without having to pay exorbitant fees? I visited Unifunds website and did not find a phone number.

October 11, 2007 Unifund Class Action request AGAIN!

How do we become part of a class action suit against Unifund?  We live in Arizona and received a summons that we were being sued by Unifund for an account that we never had and that is not on our credit report.  We answered the summons denying the claim and demanded proof of a contract that showed they had the authority to sue us.  How long do they have to respond and give us any documentation showing we owe them?
If we are allowed we want to be part of any action that stops a company like Unifund.  They file their cases in small town justice courts hoping that they will get a default judgement.  I researched the over 3000 records of cases they have filed in Arizona and the only time they have won is by default.  When do their actions become criminal?  How do people collect the fees they are out defending a civil suit filed against them for an account they never had?

October 11, 2007 Nationwide Credit for American Express SCAM

CENTURION MEMBER getting reamed by NATIONWIDE!

Long story but these guys have been harassing my wife threatening the taking of assets through lawsuit. I've tried working out a plan, but they refuse, explaining, it is not an option. I have been charging an average of 200-300,000.00 /MONTH for quite some time, and paying perfectly for years! I can get this cleared up but need some time without harassment, until my closings in 1st and 2nd quarter 08'. Please let me know if you can assist. I really want to clear this debt and move on, but I can't handle my wife calling me in tears again!

October 11, 2007 Portfolio Recovery Complaints Mount Up

Robert, What do you think?

 

Back in March we received a phone call from Portfolio Recovery Associates, saying my husband had a Capital One Credit card ( opened in1992 ) and the last payment had been made in December of 1998. They said they had bought the debt $1562,29 plus interest of 2,530.17 with 12% interest in the future.  We explained to them this was a mistake and that it wasn't ours and that we never had a Capital One Card . ( We believed it was our middle son's whose name was similar and somehow it got mixed up, of course we didn't tell them that) My son also had this declared in his Chapter 7 bankruptcy in April 2003.
We asked them for validation of the debt by .sending them a registered letter on May 14 But they were a ahead of us and sent us a letter first This letter was mailed  to us on May 7..  What they sent was my husband name, our current address the acc't number and and old address (which I believe was my sons when he lived away for a while This old address didn't even have a state or city attached to it, that we have never lived at and no social security number either .So I think their letter of validation and our letter asking for the validation letter passed in the postal system So the sent another letter .

Their second sent letter went something like this to  Quote them 

 

May 23 2007

"However, since you have submitted a dispute that is substantially the same as a dispute previouly submitted by you and we have responded to this dipute, then as per the Fair Credit Reporting Act,15 USCS 1681s-2(a)(8)(f)(ii), we are notifying you that such a dispute is frivolous and irrelevant
I am writing in response to you recent dispute.
"If we continue to received subsequent correspondence from you regarding a dispute that has already been resolved, we will consider your inquiry answered." No further replies will be forthcoming unless you provide the information we need to assist you, Our Office considers this matter closed"

This letter made us think the matter was resolved and closed. So we did not hear from them from them until Aug 28 2007. Then we get another bill for the same thing. On September 21 We get a letter from an Attorney's Office Strauss, Factor, Laing & Lyons (401) 456-7000 an attorney right here in Rhode Island,,,saying we have 30 days to respond...its signed by Lynda Laing.

 

Again this is not my debt. I  hired an attorney 2 days after receiving this last letter. I will not pay something that is not MINE Also the attorney that handled the Bankruptcy for my son on this matter is now mine.
Haven't heard anything yet.

What's you opinion.

 

I get stressed and sick over this kind of stuff real easily.

 

Haven't been eating or sleeping well, My husband is a retired AIR FORCE OFFICER ,HE SERVED IN VIET NAM AND DESSERT STORM. We are honest people have always paid our bills and have a nice house with 7 grandkids Let me know what you think please?

October 10, 2007 Franklin Squires and Rick Koerber owe me $30,000- And Says They Can't Pay!

Hi.  I just wanted to thank you for all of the great information you have provided regarding Rick Koerber and his money scam.  I invested $30,000 of my mom's retirement money in May and started looking on the internet just two months later when I called the note in and was told they didn't have the money.  Interest payments subsequently stopped as well.  I contacted Michael Hines like your website said and got the ball rolling from my end.  I don't understand why more people are not willing to step up to the plate.  Koerber is the bad guy right?  I can't decide if the people I invested with (neighbours') are bad as well or not.  Anyway, I wanted to say thanks.  I'm worried that Koerber is going to walk on this one too.  What do you think??  My phone number is 801-372-0540.  My email is wendyhendry@msn.com.  Thanks!  Wendy

I received a call from consolidated resorts /Tahiti village Las Vegas. they told me they decided to release me from the contact. you do have huge power, I've been begging to them for month). they told me they are going to send me some papers, I have to a certain certain agreement before they cancel my contact. QUESTION: I bought tihiti village timeshare on a tour Aug 11 to aug 13, we sighned the contact on Aug 11 saturday, I cancled it on Aug 17 friday, they told me I was one day late for the cancelation.(they say 5 days canclation means 5 calendar days not 5 bussiness days).in my cancelation letter, I also mentioned I sighned the contact under high sale press and the sales man lied to us, so I had a telephone meeting among the sales , company manager and me, I asked the sals 3 questions, 1. did you know you can get much lower price to get the tihiti village timeshare else where ? he answered "no". my second question was 2.during the sals , you told us you bought a timeshare in tihiti village too, what was your price? the sals could not answer that question, instead anwer my question, he kept saying " that is not your business".
I really have a bad feeling about consolidated resorts , a feeling like you cannot trust anybody anytime in this world.I now facing the letter they sent to me with the copy of contact on which full of my signatures,l felt like a animal caught bt  a well designed set up.shame on consolidated resorts tihiti village.

Here is the deal, I want you to print out this letter and send it to the Director of Sales at the Resort.

Dear Tahiti Resorts,

So, if you resolve this matter in a proper manner, you will avoid Attorney General Complaints, Rip Off Report Complaints, Division of Consumer Protection Complaints for the State of Nevada, Clark County, and the BBB. BUT you will also avoid the onslaught of previous customers that you have oversold.

Please let this gentlemen know within 72 hours, and be advised that all calls will be recorded and posted on this site, along with the previous outlined call.

So far, every single person that I have profiled on this site that has contacted Wyndham DIRECTLY has been refunded and released.

They know who we are and they have a massive issue with sites like this.

 So, Call Wyndham, explain the situation, and explain the fact that he had to pull money out of his home to cover this.

IF THEY DO NOT REFUND ALL OF THE MONEY, CONTACT ME ASAP, AND WE WILL RUN A STORY AND A PRESS RELEASE ON THIS.

A doctors note saying that he is not capable of understanding a transaction like this would also help. I will post that on our International Site, should they refuse to refund.

I think that you need to have you, your father and his doctor write a letter to Wyndham.They will release him. They are to high profile and Customer Service is WAY too important to mess with this. I would also forward this letter to them.

August 20, 2007 NCO COLLECTIONS ABUSE ....AGAIN

Hi Robert,

Below is a conversation I had with a debt collector on Saturday, August 18th, 2007. I would like to know if I can be treated this way. Hopefully you can give me some advice or help. I am located in Saint Petersburg, FL.

Saturday August 18th 2007 8:16 AM: Message left on answering machine as follows: Michael Fratone very important you return the call. Legal matter being forwarded to Pinellas County. Very important that you or your attorney contact me immediately to discuss. Can be reached at 888-251-5364. I need to hear from you or your attorney within 48 hours. Again 888-251-5364.

I returned this call at approximately 9:00 am on Saturday morning August 18th, 2007. A woman answered and said hello. I said someone had called and left a message to call this number. She asked my name and I gave it to her. She then said she was calling about a dept for Bank of America in the amount of 9355.00. I said OK. She said I had two options. I could pay 1870.00 down and 200.00 per month to pay off the dept or a settlement of 5600.00. I then asked her for her name and she said Chris Jones. I then asked what company she was with and she said NCO. I told her I could not make a decision today being it was Saturday morning and that I would need to make some calls and talk with some people to see what I could do. She then said let me see if I can get you an extension until Friday and put me on hold. At this point it seemed all was well.

Then another man gets on the phone and starts out by saying we are not going to accept 200.00 per month. I said wait a minute. The woman I just spoke with gave me two options. He then restated her option of the 1870.00 down and the 200.00 per month. Then continued by telling me that I will have attorney fees of 4000.00 and that all my assets will be brought into this. I told him I could not make a decision today and the woman I previously spoke with said I had until Tuesday. (Now the conversation was going so fast that I can’t remember where Tuesday came from or did I mix it up with the 48 hour deadline from the voicemail). He called me a liar and told me that I was being rude. This comment of his was made several times during the conversation. He continued to say that I needed to decide now. I asked him if he had a money tree in his back yard and he said no. I responded that I did not either. I told him again that it was impossible for me to make a decision today. He put me on hold and then came back and said he just checked and said I have 1300.00 available cash on a chase credit card and I could use that. I told him I did not want to do that. He then said he was voiding out all previous options and that I had until 12 o’clock today to make my decision. I asked to speak with the woman I spoke with earlier and he told me she did not want to speak with me. I asked him again if he would put the women back on the phone and he again stated that she did not want to speak with me. I again stated that a decision could not be made today, I said goodbye and hung up the phone. I never did get this man’s name.

August 20, 2007 Allied Interstate Collections - The Saga Continues

Robert Paisola:

My family and I recently moved.  I received a bill for $315 at the end of June, 2007 from my phone company.  On July 6th, 2007 I called Embarq (the phone company) and informed them that I would be moving and need to disconnect my service effective July 10th and receive a final bill.  The phone representative told me that I should not pay the bill I had received, but wait to pay the closing bill which would be sent out after service termination.  This was because there would be a credit applied and the actual amount would be lower.

On August 7th, 2007 the closing bill was cut for $255 due Aug 31st.   On the same day, a collection letter was cut from Allied Interstate claiming I owed them $315.  The letter indicated that I had to notify them within 30 days if I disputed the debt.  So I called the phone company to verify that the correct amount was $255—they said yes and they accepted my payment over the phone.  The representative at the phone company said that based upon the notes in the computer record, the account should not have been sent to collections—in any case, the account was paid in full and closed as I requested.  They have since sent me a letter confirming all of the above.  They told me that they would inform Allied Interstate, but also advised me to contact Allied Interstate directly and inform them of the conversation I just had with the phone company.

When I called Allied Interstate, I spoke with “AJ.”  He almost immediately started “talking over” me.  After several requests, he let me finish my initial statement.  To which he replied that I was not telling the truth.  Several times during the conversation he repeated the claim that I was not being truthful.  I asked to be transferred to a supervisor.  He replied that there were no supervisors on duty at that time.  Later he told me that HE was the supervisor and that is why he didn’t transfer me.  I asked him for his name—he would only give me “AJ.”  Then I asked for an employee ID number—He said they didn’t have ID numbers (I found out later that this was untrue).  I asked him to acknowledge that I had instructed him not to call me concerning this account in the future—he would not.  I asked him to acknowledge that I had informed him that I disputed the amount on the letter they sent—he would not.

This doesn’t rise to the level of difficulty that many have had, but the tone and MO are the same.  I have reported my experience to the appropriate State Attorney General’s, the Better Business Bureau, and the phone company involved.  I hope this is all over.

August 19, 2007 American Express and Nationwide Credit ...Again

Hello,

Friday I had a very unsettling conversation with these folks at Nationwide Credit. They have my AMEX in collections. The balance is $10,013. I was able to have the account held  by promising a $200 payment on Wednesday.  They want me to borrow more money, get a cosigner, etc., etc., to pay this bill in full. I told them that borrowing money to pay off credit was what  got me in this position in the first place.

I am supposed to call them back by Monday, August 20 between 3:30 and 4:00 EDT and let them know what I have been able to do to pay off the account. Well I am not willing to borrow any more money, and frankly with my debt to income ratio it wouldn't be possible without a cosigner. I am willing to negotiate a payment plan, but they insist they don't do that, which I am certain is a lie.

I am not sure if you will be able to answer this by the time I have to talk to them on Monday, but I was wondering if as long as I am making monthly payments if they could pursue litigation. I believe that they have to consider a reasonable offer, which I am prepared to make. Any advice?

August 19, 2007 Fairfield Resorts and Wyndham... Again

Dear Robert,

Several years ago, my husband and I purchased a small amount of timeshare points with Fairfield Resorts, now Wyndham Worldwide’s subsidiary.  We have since “upgraded” to VIP Gold status, with a 500K point ownership.  The payments were manageable for that amount. 

Foolishly, we “upgrade” once again to the VIP Platinum, with 1,154,000 points of ownership.  We are making the payments, though they are just more than we prudently should be making.  With the taxes and maintenance fees, we’re paying $1900.00 a month. 

Prior to our foolishly making this last upgrade, I’d been injured, am now partially handicapped and had resigned from my full-time teaching position.  Even though my health has not improved, I have felt forced to return to work so that we can handle this excessive payment – one we took on; it’s our own fault.  I am ashamed to say that we had stars in our eyes about all the vacation time this would allow us – for which we really can’t take that much time.

So, I am wondering if we could stop paying and have them repossess the deed.  I know that they propose to prospective customers (during the presentation phase) who are having a hard time with the purchase price that there are deeds, for less money, that they have “reacquired.” They deliberately refrain from saying repossessed and allude to other owners having traded this for another deed.  This may merely be one of their lies in the presentation process but I believe there must be plenty of others like my husband and me who have “bitten off more than they could chew” and it is from those that they have this reduced-priced inventory. 

What, if any, experience have you had specifically with Wyndham?  Locally in Virginia Beach, there is a timeshare company at the oceanfront called Gold Key Resorts.  I know several of the sales and finance people there.  They have all counseled me to stop paying and that the deed will be repossessed and that’ll be the end of it.  I wonder if, being that Gold Key isn’t a global company, the expense of pursuing legal action outweighs their gain from reselling the deed and if Wyndham would pursue the legal action since they have far more resources.  Can you help us?  I am most interested in hearing what you can do for us, suggest to us, etc.  I fear that we are stuck until the market improves and we can sell this to someone else who can both afford and use it.

August 17, 2007  Your Seminar Changed My Life

I saw you today in St. Louis, and was most impressed by you and what you had to say. I’ve always believed Real Estate is the best investment. I dream of investing in it someday.

I am a single mom of 6 children. The road I have travelled has been long and complicated. I have been through two divorces and a bankruptcy with each. My first husband was an abusive alcoholic and abandoned us when I was expecting my fourth child. The second marriage was pushed to the brink when my former husband took all our home equity and assets and put them into his families failing computer hardware company. The equity in the home had been a trust given to my children by my father. During one of the second mortgages my former spouse had arranged to exclude the trust from the title and the trust was lost. We were headed for foreclosure when we separated, so my father purchased the home and allows me and my children to live in it. The house was originally purchased for $300,000. By the time my father purchased it the mortgage was $400,000. The home is now valued close to $600,000. The verbal agreement I have with my father is: he will get $400,000 + any costs of maintenance and repairs + $2500 each month I live in it (the monthly mortgage cost) when the house is sold.

There are several reasons why we don’t sell at this time. Some are legitimate; like size for a family of seven. Some are circumstantial; like I have a child with Cystic Fibrosis and her monthly cost of health insurance is over $900 which is also being paid by my father. Some are emotional; like my father refuses to discuss alternatives until I have sound options. I feel stuck and powerless.

I continue to attend seminars and motivational events to stay positive and inspired. I know in my heart God wanted me to make personal sacrifices for the good of my children. In spite of physical abuse, alcoholism, and the turmoil of divorce, I have raised outstanding children. They help support the household by working hard and paying for most of their own expenses. One of the reasons I keep the house is because we save money on college by the older children living at home and attending a junior college. They are truly some of the most loving and empathetic people I have ever known.

I am proud of my parenting, but there has been a cost. I have not provided well for our financial well being. I have no money or financial skills at the age of 47. I am determined to develop this area of my life. I have worked hard and regained security in all areas but finances, and so my focus is on achieving financial security. I was wondering if you offer scholarships of any kind for you seminars. If so I would love to be considered.

August 17, 2007 LDG SERVICES GOES OFF THE DEEP END ... AGAIN

We talked with LDG Services today to a Person named Melissa Cory, who got super angry because I asked her name and the spelling of it and she is the front person for this phone contact.  They call from 813-283-200 and then you can't call them back.

 They have a recording that wants you to call them back at 1-866-281-7743.  We thing we are getting calls from our grown kids or grandchildren and it is these hateful computer recordings. 

 We are listed on the Federal Do Not Call List to stop all the garbage that assaults us and we are trying to stop the spam and the junk mail at home.

 Finally after getting angry because they forever and then suddenly decided to  put me through to a person of Thomas Holcom who is the Manager.

 When I asked him who he was he said I'm with LDG Services.  I asked him what it was and he said a collection agency.  I said where are you located and he said two places, why.  I said I want to have my attorney contact him and he said, that he would contact my attorney.  I told him, my lawyer would not appreciate a call from a stranger and this is true of both of them.  Neither have time to talk to a fast dancing nebulas person that is hiding and will not even tell me what they are having a computer call our house ever since Spring of this year. 

 We are about to the point of having the phone disconnected as my wife is a nervous wreck fro these nebulous recording that state, "call us". Why should we?

 Then he said you have a problem with Verizon and they have contacted him to do something for them.   I asked him who and he would not tell me.  He told me to call a local office and then get the 800 number and track down Verizon wireless.  He said that this all started around 3-29-07 and as Florida was a Debtor State that they will call me from all over the United States whenever they feel like it.  He said they or someone else was also doing this to us.  We checked our credit report and sure enough this is true.

 I have no idea where this is all headed since two years ago, we returned some phones to Verizon and have the paperwork to prove it.  All because of some overcharges as our Childs phone was stolen and then she used her mothers to track it down from some horrible dope dealers in Tarpon Springs, off the Pinellas Trail.  Our daughter, thank God is now in a recovery program and is to finalize that next year

 I will likely use some of this information I'm sending you to send to the credit report people as we are contesting the changes by Verizon as you can never talk to anyone who has an education but is a book follower and if it's not in their script they don't know what to do so they keeping increasing a small bill and then bill you more money and never actually provide customer service in the real sense. 

This guy I talked to today said that he is going to put something into the works as I "Refused to Pay" and I don't even know what I am supposed to be paying for or to whom? 

This is the most clandestine thing I have ever experienced in my life. I am going to share this with the local news channels and also with Verizon if I can find out who to talk to.  This will be the true challenge.  Talk about the asterisks on commercials!  Yes, what is it, what is it, what is it?

August 17, 2007  An Example of a Corporate Account Billing Dispute - Why we do not collect on Consumer Accounts!

I really hate to keep going back and forth on this as well, its always difficult when a client doesn't want to pay for services they agreed too. If we decided to take William Lyon to court, could we could have Saudia and Shannon testify under oath that they knew exactly what they were authorized to "approve" and that they knew if they did not place any orders through the system that they would be billed for our programming hours? 

 I explained this to Saudia and Shannon on several different occasions explaining to them how we do business, and Saudia and Shannon were in complete agreement.  It's not our fault that William Lyon did not initiate the correct training of their employees on how to use the cyberdocs system and therefore deciding not to use a fully functional system that they themselves requested. In speaking with our head legal counsel Paul Fosco he advised me of a legal concept called "apparent authority". If one company (DX) is dealing with people from another company (WL) that appear to have the authority to act on behalf of the corporation (Shannon and Saudia), then their decisions will bind their company. There is no need for us to independently verify whether they actually had the authority or not. William Lyons position on that issue is pure BS. Paul is confident that her e-mail would be completely detrimental to their case and would probably be considered a judicial admission of guilt relative to this issue if litigated.

i never once dealt with Mark Carver, in fact I don't even know what his daily functions are at William Lyon.  All contracts were held Saudia Casper. 

Everything went through Saudia and Saudia and Shannon knew that if they did not order through our system after we performed the programming requests that William Lyon requested that they would be billed for our services.

Saudia and Shannon both told me this many times that they knew exactly what the agreement was.

 If we have to we are prepared to go to court for money we feel is rightfully deserved. We want to explore every avenue if that is what it takes to get payment from William Lyon.

Please let me know what your thoughts are on this situation.

I just attended an event here in St Louis today and couldn't wait to get home to write you. By far i thought you were the best of them all. I sat on the edge of my seat from the time you first open your mouth till the your final word. I'm still in shock & in a daze because the way you think, your ideology, words of expression, how you enter act with the poor & help them at the drop of a hat & the way you rise your sons is so consistent with my way of life & to hear someone else say the the same things iv been saying & doing for years scared the heck out of me. you go left when every one go's right, you love being different than others and I believe when you said that God put us/me in that dome at that moment to hear you & all the others is a confirmation that I am on the right track to major success's have a beautiful home with not a dime to my name and I cant wait till the day comes when i give my 2 weeks notice to my job that i will no longer need because of the wealth that this real estate game you artistically spoke about. When hear that your class cost $5,000 ,my hard fell in my lap because I knew that there was no way i could afford that fee. I have paid for knowledge & training many times over and if i could have i would have been the first one to sign on with you. I feel that im left sort of dangling, pumped up with all this energy ,greatness & hope from you presentation yet I don't have a means to meet your requirements in order to gain access. Please don't get me wrong, my real estate investment future doesn't end because of this matter because i'm going to get there some how, but you got the juice baby & being under your companies wing would have gotten me where i should have been long ago just that much smarter & faster. Ether you must have been in my head all these years or i may have met some kind of spiritual soul mate in you sir. I was just reading on your website about a situation similar to mine. In Nov. 1997 I leased a car so that a friend could use it who promised me (orally) to cover the payments but did not do so. I could not afford the payments myself and when the First Union (now Wachovia) kept calling me I told them to just take back the car and leave me alone. My friend had it in PA and they took it and sold it somewhere but there was a deficiency around $6000+, and they kept calling me about that, and later they sold the deficiency to Troon Company collection agency. I was making small payments to them and I think the last one was in 2004 or earlier. Due to tight finances I was unable to continue payments and did not hear from them until just this month (see letter below). Should I be worried about this? Did my payment to Troon in 2004 reset the clock? I don't have much assets, I owe $5K on my car which has 180K miles, and I make just enough to get by.

 I plan to write to them and say I dispute the debt and that the lease contract is past the Statute of Limitations and not to contact me again. Can you advise me on how to word it? Remember, Troon Company is not the original creditor, it's First Union (Wachovia).

 NOTE: if they offered to settle for $500 or so I would be tempted to agree to it. Letters from lawyers make me sick to my stomach and lose my appetite and be unable to function normally. I went through this last year with Chase and ended up paying them 70% of a $3000 CC acct. I can't afford to hire an attorney.

Hi, my name is Stephen and while doing some research online I came across the following website (http://www.ripoffreport.com/reports/0/191/ripoff0191302.htm ) which provided me with your name and email address.  I am hoping that you can spare a few minutes to explain the relationship between Intellirisk, Allied, Coldata, and HRI Consulting to me.  Are they all the same company?  From what I can tell Coldata was terminated in 1999 and acquired by Intellirisk, but I'm not sure how the others fit into the mix.  I know someone being harassed by HRI Consulting and because they have an office in the same building as Coldata I was wondering if they are really one and the same.  Any light you can shed on this would be most appreciated.

  I am writing because we were owners of a Wyndham timeshare (Ocean Blvd)  and a Bluegreen timeshare.  We attended a meeting in July while on vacation in Williamsburg (Wyndham).  In this meeting we were told that we could reduce our membership fees, increase our ownership, and combine our Bluegreen resort if we simply transferred our ownership from Ocean Blvd to Star Island, Orlando, FL.  There was a big spiel on how it did not matter where you owned, etc, etc.  We liked the idea of less fees and the ability to combine both timeshares into one usage.  We foolishly agreed, but upon reading the contract we found there were some things that were not entirely disclosed or were misrepresented during our meeting.  We tried to contact our Rep, but ,of course, were unsuccessful.  We then, as per contract, sent a certified letter requesting to not go through with the sale and to resume our old contract.  We heard absolutely nothing for 2 weeks.  At that time we received a letter stating that we had only 7 days to change our minds, but we could; however, send another certified letter claiming any misrepresentation or failure to disclose info...the catch was that our 30 day period in which to do that would run out in 24 hours.  We wrote a letter, faxed it and sent a certified copy.  We hold that one of the undisclosed items is a mention of Club dues, and taxes, to be paid over and above the maintenance fees.  The taxes were mentioned and an estimated amount, but the Club fees were no where to be found.  Of course, all of these fees are subject to go up and our usage would never increase, but may very well decrease.  Upon making an effort to go about resolving this and getting absolutely no assistance from Wyndham, we have now decided that we do not even wish to go back to our previous contract...we just want out.  We have seen just how accommodating they can be, and how when you have a question they simply refuse to answer, but they make no bones about demanding that you hold up your end of the bargain..never mind if they don't hold up theirs.

  We are considering just cutting our losses and refusing to pay.  What recourse do we have?

Thank you for your web site. You might have just saved me a huge headache. I am having trouble selling a home and Hill Erickson offered to step in and purchase the home via seller finance. After doing my research I do not think I will go forward in deeding the house to a company who's parent is under investigation. August 14, 2007   WESTGATE RESORTS SCAM

I recently read your answer to Donna about West Gate. We were recently on vacation and were offered free tickets to listen to a presentation that lasts about 90 minutes about West Gate timeshare. We were approached on the street and were asked to put up a deposit of $20.00 and were told that we would get it back. We should have known that was sign of a scam at work. We listened to the presentation and saw the facilities. This was a very nice facility and we would probably had suggested it to someone else if we thought it would be something for them. The salesman was nice at first and very informative. He told us up front that he was not going to pressure us into buying anything. After listening to the presentation, we told him that this was not something for us. We don't take many vacations ( only day trips) and do not have the extra money for buying somthing of this expense. He went to get his manager so we could get our free gifts... His manager came over and started on the sales pitch of how much we could buy a unit for. When we told him we were not interested, he started talking down to us about how we were putting the salesman's job in jeopardy by listening just to get free gifts. He said that we definitely didn't look like a couple that needed a free vacation. My husband is also a salesman and if his boss talked to any of his potential clients the way Mr. Mike Burkitt talked to us he would be out of business. Then the salesman we talked to made a complete turn around.. He acted like we were intruding and treated us very rudely. We hope no one else has to experience the rudeness that we went through. Maybe this is a tactic to upset people and make them leave without what they had been promised. But as I said earlier this was a very nice facility and we might have recommended it to others, if we had not been treated so rudely. I hope when you train salesman , you teach them that treating people like they are your best customer, might change their mind later. We will never go to another timeshare presentation again after this trip.

We are small business. AMEX internal collection department has started demanding payment by tomorrow or it will go to outside collections department and immediately go on my credit as the primary card holder:

Balance is: $58,034.68
-$25,051.19 was due 5/18/07 87 days past due
-$30,508.38 was due 6/19/07 55 days past due
-$ 1,790.26 was due 7/18/07 26 days past due
-$ 684.55 late charge 8/4 09 days past due
My question is: Should we offer and pay anything at this point? We are trying to take out other loans in order to pay this because we do not have the money.

Any advice or help in this matter would be greatly appreciated.

August 15, 2007  CAR REPOSSESSION - CRESCENT RECOVERY

I got your email address from a website that was giving some really good information about old debt collection. I am hoping you can help me with my issue.

 In April 2001, I filed bankruptcy. I had a car at the time and wanted to keep it so I told the court I would try to keep the car. After about 40 days it became oblivious that I could not keep the car. So I called my lawyer and told him I wanted to turn the car in.

 He wrote a letter and about 2 weeks later the cops came and got the car. The car was sold at Police auction and that was that. I never seen it again nor was I contacted about a debt again. I was told at the time, over the phone, by the loan company that I did not owe a dime. This was 2001.

 In 2006 I went to refinance my home and seen a company on my credit report claiming I owe $17000.00. I sent a dispute to the Credit Company and next thing I know I get a letter of rejection from the credit company stating that it is a real debt. I did not recognize the name of the company so I called. It was a company called Crescent Recovery. They purchased the debt from my original car loan company who is not out of business.

 They said the 17000.00 was debt plus interest from 2001. I told them I did not owe the debt, that the car was picked up as part of a deal and that was that. I never heard from them again until tonight and yesterday via mail and phone. Tonight they called again saying I owe 18000.00 plus. Now we are in 2007….. They still appear on my credit report and they won’t prove to me how I owe anything at all. All they say is you owe us! I asked them to take me to court or send proof.

 I want them off my credit report and I am never going to pay 18+ - ever…. So what can I do? I got a letter yesterday stating they wanted to make a deal. So I am guessing that they know they have no proof…

 I think the statue of limitations is 10 years in Louisiana. That is where I got the car and signed the loan.

 I am moving to Tennessee in 2 days. Can you help?

 


August 08, 2007- Unifund Abuse Continues in Georgia

Dear Mr. Paisola:

 

I have a relative in Georgia who is being sued by Unifund CCR Partners for a Goodyear debt for $835.00 plus interest of $254.24. She isn't represented by an attorney because she can't afford one. They have told her that they will win in court and then they will garnish her check. She is a single mother and only works part time. She is willing to settle the account for $540.51 in monthly installments of $91.00 per month over a six month period.

 

What should she do? Her answer to the complaint is due this Friday, August 10. She is going to put in her answer her willingness to pay the above amount.

August 07, 2007 - AMEX AND NATIONWIDE CREDIT- HERE WE GO AGAIN!

Hello Robert,

 I enrolled in a debt management program due to financial difficulties and all of my creditors agreed to the terms besides AMEX. I have 2 cards a Platinum and a Gold charge. AMEX wanted to settle with me for 75% of the balance and at that time i did not have the full balance. Now I'm in collection (primary stage) with Nationwide Credit and they are telling me that they can only settle one of the accounts, the Gold charge with balance of $1200 and they will take 60%, but they will not settle the larger balance of $3600 on the Platinum card, according to AMEX's terms. Supposedly they tagged this account as "not to settle" My question is it possible for them to want to settle one account and not the other, can it really be AMEX terms, when they originally wanted to settle? Also, they want settle the smaller account if I don't put anything down for the larger balance, can they do that?

August 07, 2007- NCO IS CAUSING ME TO LOOSE MY BABY UNDER STRESS

Hello, my name is DaJohn Ross and I was completely, and still in awe after reading a post you listed stating that the NCO company is a scam. There reason being is they are currently taking money out of my account for a debt that I due owe, but I was explained to by another person with a consolidation program that it was odd that the company that actually has the account is not the people that I am currently paying the money too. So it would seem to me the holder of my account is still looking to put my wages in garnishment while I am paying a scam company my little bit of funds I have. Please help me. I am young I am pregnant and I have only a little sanity left, and I am trying not to get too stressed and lose my baby.

Is this lawsuit for real?  I currently am in financial distress after purchasing two properties in Lee County from Austin.  My savings have been exhausted and I am facing bankruptcy.  I am desperately trying to hold on to my primary residence.  My health is failing due to the stress of these transactions.  How do we as consumers redeem ourselves after a fiasco such as this?

August 02, 2007- UNIFUND ABUSE AND SESSOMS AND ROGERS

Hello:

 I am being sued by Unifund and have done a lot of work on my own.

However, I believed that I can not handle this without an attorney.

 

I am in Rockingham County, North Carolina and the trial date has been set for Sept. 24th.  I had an order from the court to pay attorney fees to Sessoms & Rogers from Durham, NC.  I did discovery and nothing from Unifund will hold up in court, it is all hearsay. I filed a MTS the evidence and a MSJ.  The judge did not listen to me at all.  The judge refused to hear the MTS and then denied my MSJ.  Then I was slapped with

  a court order to pay Sessoms & Rogers attorney fees because I did not answer Sessoms & Rogers interrogatories.  I did answer them as fully as was possible for me.  I told this to the judge and the judge wouldn't listen to me. The judge simply took Sessoms & Rogers word over my word without any evidence.  It is clear that a Pro Se will not be listened to in court.  Discovery papers are not filed in North Carolina.  BTW:

Sessoms & Rogers did not file an opposition to my MSJ or enter arguments against my MTS or MSJ.  Yet, my MSJ was denied.  I am being railroaded by the court system here in Rockingham County, NC.

 

If I don't get help, I will lose to these scumbags.  The law firm of Sessoms & Rogers are no better than Unifund.  They will lie and cheat their way through.  I have no idea if I can get the court order to pay attorney's fees vacated.  It was $800.00 ($200 X 4 cases)  I only work part time at min. wage.

 

Please help me or point me to an attorney near me that can help me.

A Legal Question

Just had a legal question........we made our last payment to Sears credit card in 1/06 experiencing hardship...anyhow, was slapped with a lawsuit in July 06.  Were told that if we paid $300 a month they would take it off of our credit.  Anyhow, the initial balance was $3736.00  and after paying $300 a month for the past year or so, our balance as of March was $3495.......can they do this?  It's a lawfirm/collection agency.  I mean we have already paid $3, 900.00 by this month!!!!   and now they want us to pay that all over again?   Please give me some advice!  Thanks so much.....   Lisa Pond

Westgate Resorts - One Big Big Scam

My husband and I were "pressured" into a partial deal with the Westgate people.  We signed up for the vacation traveller.  We were told by Nathan Blanton (at Gatlinburg Westgate) that after we went for our one week stay at any other resort and that if we did not like it and did not then want to buy into the timeshare that all of our money would be refunded and that the vacation would be on them.  He said "You can't lose!"  Needless to say, after a year of dealing with finding out our daughter had Juvenile rheumatoid arthritis and many other problems, we go to take our one week stay at Westgate Lakes and guess what we are told when we say we can't afford to buy in right now?  We NEVER refund anyone's money.  You must have been mistaken.  Since we don't have that part in writing I guess there's nothing we can do, huh?  Just add us to the list of people who HATE W
